These Terms and Conditions (“Terms”) govern your access to and use of all digital products, services, online programmes, courses, coaching sessions, downloads, memberships, communities, templates, guides, resources and related offerings (“Products”, “Services”) provided by Digital Flow by Kay, owned and operated by Kreator Mind Ventures (“we”, “us”, “our”, “Business”), including but not limited to those sold or accessed through our official website (https://www.digitalflowbykay.biz), as well as affiliated platforms such as ThriveCart, Instagram, YouTube, and any other official Kreator Mind Ventures sales and/or content channels.

By accessing, purchasing, enrolling in, using or attempting to use any Product or Service, you (“you”, “User”, “Customer”, “Member”) agree to be bound by these Terms.

If you do not agree to these Terms, you must not access, purchase, enrol, use or participate in any Product or Service.

1. ACCEPTANCE OF TERMS & AGREEMENT

Accessing or using any Product or Service constitutes:

Acknowledgement that you have read, understand and agree to be legally bound by these Terms;

Consent to all policies referenced herein, including the Privacy Policy and any disclaimers;

Agreement that you will comply with all applicable laws, regulations and guidelines.

2. ELIGIBILITY

You represent and warrant that:

You are at least 18 years old or possess legal parental/guardian consent and supervision to use and/or purchase Products and Services;

You have legal authority to enter into these Terms;

You will provide accurate, current and complete information when registering, purchasing, subscribing, accessing or using any Service.

You may not use any Product or Service in any jurisdiction that prohibits such use. If you are accessing or using our Products from outside of your country of residence, you are responsible for compliance with local laws.

3. REGISTRATION, ACCOUNT & SECURITY

If you create an account:

You agree to provide accurate, complete and current information;

You are responsible for maintaining confidentiality of login credentials;

You are fully responsible for all activities that occur under your account;

You must notify us immediately of any unauthorized use of your account or password.

You must not share accounts, credentials, access codes or offer unauthorized access to any Product or Service.

4. PRODUCT & SERVICE DELIVERY

Digital Products: Delivered via URL, secure login, email or third-party platform on purchase or enrolment.

Memberships & Subscriptions: Automatically renew as per billing plan until cancelled by you. You remain responsible for all charges incurred.

We reserve the right to change Products, descriptions, features, pricing, formats or content at any time without notice.

If you do not receive your digital product access or login information within 2 hours of checkout, please reach out to digitalflowbykay@gmail.com and I'll help you get access as soon as possible.

5. PAYMENT, BILLING & REFUNDS

All payments must be made via supported payment methods.

You agree to pay all fees associated with any Product or Service you purchase.

All prices are displayed at the point of purchase and are subject to change without notice for future transaction

You authorise us and our payment processors to charge the payment method you provide for all amounts due, including recurring payments where applicable.

Failure to complete payment may result in denial, suspension, or termination of access.


No Refund Policy Unless Required by Law:

All sales of digital Products, Courses, Coaching, Memberships and Services are final.

No refunds will be issued except as required by law.

This includes partial, pro-rata or discretionary refunds. You acknowledge that due to the nature of digital goods, access, value and delivery, refunds compromise the integrity of our business.

We may update pricing at any time, but price changes will not affect charges already processed.

6. WAIVER OF RIGHT TO DISPUTE CHARGES

By purchasing any Product or Service, you expressly waive the right to dispute charges through your bank, credit card provider, or payment processor without first attempting to resolve the matter directly with us.

You agree not to initiate chargebacks or payment disputes without first contacting us at digitalflowbykay@gmail.com to attempt resolution.

Unresolved chargebacks or disputes may result in immediate termination of access to all current and future Services.

7. LICENSE & INTELLECTUAL PROPERTY

All content, branding, materials, designs, graphics, text, audio, video and other deliverables in our Products and Services are the sole property of Kreator Mind Ventures and protected by copyright law.



Limited License to Use:
You are granted a limited, non-exclusive, non-transferable, revocable license to access, view, download and use content for your own personal, non-commercial use only.

You may not:

Copy, reproduce, redistribute, sell, modify or create derivative works of any Product, Service or content;

Share login access, files, downloads or proprietary assets;

Claim ownership of content or materials.

8. USER CONDUCT & PROHIBITED USE

You agree not to use any Product or Service to:

Violate applicable laws or rights of others;

Transmit harmful, defamatory, obscene, offensive, abusive or illegal content;

Attempt unauthorized access or disrupt operations;

Use automated data collection tools that compromise systems.

All Products and Services are provided for your personal, non-commercial use only.

You may not copy, reproduce, distribute, resell, sublicense, share access credentials, or otherwise exploit any Product or Service without prior written permission.

We may suspend or terminate access for abusive conduct and pursue all legal remedies available.

9. USER SUBMISSIONS

Any feedback, suggestions, ideas, or materials you submit (“Submissions”) may be used by us without restriction. You grant a perpetual, irrevocable, royalty-free license to use such Submissions for any lawful purpose.

By using the Services or providing your contact information, you consent to receive electronic communications related to the Services, including transactional, administrative, and marketing communications. Electronic communications satisfy any legal requirement for written notice.

11. TESTIMONIALS AND REVIEWS

Any testimonials, reviews, or endorsements displayed on the Services reflect individual experiences and results. They are not guarantees of outcomes and should not be interpreted as promises of specific results.

By submitting testimonials, comments, or reviews, you grant us the right to use, reproduce, edit, and publish such content for marketing or informational purposes without compensation.

Our Products or Services may link to or integrate with third-party services. We do not control third-party content, policies or practices and bear no liability for them. You assume all responsibility when engaging with any linked or integrated service.

15. INDEMNIFICATION

You agree to defend, indemnify and hold harmless Kreator Mind Ventures, its agents, affiliates, partners, employees and contractors from any claim, loss, damage, liability, cost or expense (including legal fees) arising from your breach of these Terms, misuse of content or violation of applicable law.

16. DISPUTE RESOLUTION & GOVERNING LAW

These Terms are governed by the laws of India and Australia without regard to conflict of law provisions.

Arbitration & Waiver:
Any dispute arising under or relating to these Terms shall be resolved through binding arbitration in English, in accordance with the arbitration laws of India and Australia.

To the fullest extent permitted by law, you waive any right to initiate or participate in any lawsuit, class action, representative action, or collective proceeding arising from or related to these Terms or the Services.

All claims must be brought on an individual basis only.

17. TERMINATION

We may suspend or terminate access to any or all Products or Services, without notice, if you violate these Terms or for business or legal reasons. Sections that by their nature survive termination shall remain in effect.

We reserve the right to update, amend or replace these Terms at any time. Material changes will be posted on our website or communicated by email. Your continued use of Products or Services after changes constitutes acceptance of updated Terms.
